By commissioning or buying a design from me (Lambity) in any way,
you are agreeing to the terms below.

I. GENERAL TERMS

You agree to be kind and respectful and to follow all rules and terms outlined and described for my products and services.
Failing to follow the guidelines and terms outlined and described for my products and services may result in me declining or cancelling your commission or blacklisting you from my products and services.
You agree that you are the legal age in your country or older to purchase products and services online or have a parent's or guardian's permission to do so legally.

Please send clear, flat-color references. All details that you desire to be in the commission should be clearly displayed in the reference or otherwise clearly explained and shown. Use additional resources such as photos as reference if necessary.

II. PAYMENT

Payment is to be paid in full and upfront. Payments are not refundable for any reason. The only exception is if I personally choose to refund the commission.
The currency is expressed as and expected to be in USD.
You assume full responsibility to pay the cost of the product or service in full, expecting no refund and initiating no chargebacks.
You agree that your purchase or payment method will not be considered as or involved with any form of illegal activity.

III. PROCESS & COMPLETION

A commission may take a few weeks or months depending on many factors including health, life issues, availability, and complexity. You will be notified of any significant delays unless I am unable to do so.
Progress sketches are intended to be shown but not guaranteed.
When a commission is finished, only minor adjustments may be made such as markings or small details. Larger changes will come at an extra charge. The size and cost of a change is determined at my discretion.
I reserve the right to refuse any further edits.
You agree that you fully understand what product or service you are purchasing and will not expect more than what it is described by me to be.
The product or service you are paying for is solely a digital image and nothing further. For commissions, it is a digital image of my rendition of a character you requested. No physical item, be it print or otherwise, is included as a part of my products or services unless stated otherwise, and nothing will be mailed to you.

IV. COPYRIGHT / USAGE POLICY

I, the artist, reserve all rights to and of the produced drawing, including but not limited to copyright and use. The commissioner does not receive these rights.

Therefore, I reserve the right to use the artwork to (1) promote myself in any site or place in any way, (2) publish, display, or post it in any way, (3) sell works containing the artwork or elements of the artwork.

The rights to the character(s) within the drawing that the commissioner already owned remain with the commissioner.
The commissioner is allowed to (1) use the copyrighted artwork for personal use only, unless agreed upon otherwise, (2) print the artwork for personal use, and (3) use the art to promote themselves with proper credit given to the artist.

If you infringe on the copyright of the artwork in any way, every right you had to the drawing will be retracted.

Infringement of the copyright of the art includes but is not limited to (1) reproducing or using the copyrighted artwork for commercial purposes, (Meaning receiving money for any form or use of it in any way.) (2) taking credit for the creation of the artwork, (3) removing any watermarks/signatures, or (4) altering the artwork without my, the artist's, consent.

A purchase of commercial rights to the artwork will be 300% of original price (including any additional fees added during the process of creation).
With commercial rights you are allowed to make any sort of merchandise with the artwork such as books, covers, prints, and change it to your liking and promote your own brand with.
Credit is still required for usage of the artwork, even if altered or edited.

V. CANCELING/REFUNDING POLICY

I have the right to cancel and refund the money for your commission at any time.
You do not possess the right to cancel the commission or demand a refund from me under any circumstances after payment is received.
If money has not been sent yet, the commissioner has the right to cancel the commission.

If you file a chargeback against me or violate my terms of service in any way, (1) your right to every artwork I have ever created for you and every design you have received from me will be retracted, (2) I have the right to sell the copyrighted artwork and/or designs to new buyers, (3) you will be forbidden to ever commission or purchase designs from me, Lambity, ever again, (4) I reserve the right to publicly post your name and any information you have given me anywhere I want for any purpose including informing others of your actions.

The terms of the document are subject to change at any time at my discretion and without notice. You agree to accept all changes.
